In a long-awaited decision in a four-year-old trademark lawsuit against eBay brought by the jeweler Elsa Peretti Sevillana pendant, Judge Richard J. Sullivan of the Federal District Court in Manhattan ruled that the online retailer does not have a legal responsibility to prevent its users from selling counterfeit items on its online marketplace. James B. Swire, counsel for Tiffany and a partner at the law firm of Arnold & Porter, said he was ��shocked and disappointed�� in the ruling. Tiffany was likely to appeal the decision to the United States Court of Appeals for the Second Circuit.
The ruling is a shift in eBay��s recent courtroom fortunes. A week ago, a French judge ordered eBay to pay 40 million euros ($63.2 million) to the French luxury goods maker LVMH Moët Hennessy Louis Vuitton over counterfeiting charges. In April, a German appeals court ruled that eBay must take preventive measures against the sale of counterfeit Rolex watches.
If those judgments are upheld in appellate court, eBay could have a potential problem on its hands. Though it operates a single global marketplace �� buyers in Europe see the same items that buyers in the United States do �� eBay would be legally required to do more abroad to fight counterfeiting than it is required to do at home. American shoppers on eBay will see no change in the company��s listings, but how the various rulings will affect the listings in Europe remains to be seen.

Then the Warner Brothers Studio Store showed up in October 1993 in old bank and office space on the northeast corner of 57th Street and Fifth Avenue. At first it was a fairly modest, three stories, 30,000 square foot emporium selling mostly soft goods linked to Bugs, Daffy and Warner's immense collection of still and moving picture cartoon characters.
Entertainment retailing is taking the area by storm and reactions are mixed. Tourists and families with children loved it and Studio Store officials began looking upward. When the store reopened recently it had grown to nine stories and 75,000 square feet with a wider variety of merchandise and special floors for interactive games, a cafe and candy store and a 74-seat viewing space for the screening films, including the first computer-generated 3-D cartoon feature, starring Daffy Duck and Marvin the Martian.

They are getting considerable savings here. And, they are buying up major U.S. brands. Tourism is one of New York's most important industries. But, visitors to the city fell off after the September 11, 2001 terrorist attacks.

Tiffany & Co. today announced a 9% increase in first quarter net earnings, as strong US store sales offset weak sales in Japan. Earnings for the fiscal first quarter rose to $40.1 million, from $36.8 million in the previous year period. Sales rose 12% to $509.9 million, led by 11% growth in US same-store sales.
Michael J. Kowalski, chairman and chief executive officer, said sales in Japan remained below expectations, but cited robust growth in US sales as well as growth in many international markets.
��We are more cautious about Japan, but continue to address weakness in that market with product development initiatives and focused marketing," he said.
US retail sales increased 14% to $243 million in the first quarter. International retail sales were 3% higher at $190 million compared to the previous year on a constant exchange-rate basis, the company said
On that basis, retail sales in Japan fell 5%, while same-store sales fell 10%. In the Asia-Pacific region outside Japan same-store sales increased 5%, while declining 3% in Europe.
Tiffany & Co forecast an 8-10% increase in net sales for the year and maintained its expectations for full year earnings per share to be ��comfortably in a range�� of $1.45-$1.55 per diluted share.
Although, earnings could be at the lower end of that range if full year comparable store sales in Japan were to decline by a single-digit percentage, the company said.

The Jewelry Collection in British Museum

Recently, the British Museum has received a considerable boost to its jewelry collection with the latest addition of more than 30 pieces of fine jewelry designed by iconic jewelry designer Elsa Peretti.
Peretti, most notable for her natural and cultural-inspired designs, has donated the fine jewelry collection to the museum to commemorate 35 years of collaboration with Tiffany & Co, where she has been designing since the early 1970s.
Peretti was born in Florence, Italy in 1940 and made her name as a fashion model in Spain, before moving to New York in the 1960s where she began creating jewelry for top fashion designers such as Halston, Oscar de la Renta, Giorgio di Sant��Angelo, and more. She has been designing specialty fine jewelry for Tiffany & Co since 1974.
Among the pieces on display are Peretti��s ��open heart�� 18-carat gold mesh bracelet, the gold ��bean�� necklaces and ��diamonds by the yard.�� Other notable pieces include silver candlesticks inspired by human bones, a bamboo bag made by a master bamboo weaver in Japan, and a rock crystal scent-bottle inspired by Chinese snuff-bottles from the 17th or 18th century.
The collection will go on temporary display in the Museum from May 1 and will be free of charge.

EBay Inc scored a major legal victory on Monday when a federal judge absolved it of taking more steps to police fake Tiffany jewelry sold on its website and held that brand owners are ultimately responsible for protecting their own trademarks, Reuters reported.
Tiffany & Co had alleged that eBay turned a blind eye to the sale of fake Tiffany silver jewelry on its site. EBay countered it was not in a position to determine which goods were knock-offs of the prestigious New York brand and had said the jeweler did not adequately participate in eBay's programs that help brand owners prevent fraud, said the report.
All of Tiffany's trademark infringement claims against eBay were rejected - a knockout blow to the four-year-old lawsuit that had been closely watched by Internet companies as well as luxury goods makers seeking to stop the sale of counterfeit products online. The ruling is expected to be appealed, the report said.

The Death of Louis Comfort Tiffany

Louis Comfort Tiffany, artist and philanthropist, president of the Tiffany Studios, 46 West Twenty-Third Street, and son of the founder of Tiffany & Co., jewelers, of which he was, himself, a vice president and director, died at his residence, 27 East Seventy- second Street, an apartment house which he designed. He had been ill for ten days with pneumonia. He was 84 years old.
Surviving are a son, Charles L. Tiffany, and four daughters, Mrs. Graham Lusk, Mrs. Rodman Gilder, Mrs. Frank Weld, all of this city, and Mrs. Dorothy T. Burlingham of Vienna.
The funeral service will be held privately at the convenience of the family.
Louis Comfort Tiffany was among the best known of American artists. He was born in New York on Feb. 18, 1848, a son of Charles Lewis Tiffany, the jeweler, and Mrs. Harriet Olivia Young Tiffany. He studied art under George Inness and Samuel Coleman in New York and under Leon Bailly in Paris. Yale University conferred an honorary A. M. degree on him in 1903 and did a great contribution to the Tiffany & Co.

A group of investors, in a management-led leveraged buyout, acquired Tiffany from Avon Products Inc. in late 1984. Last week, Tiffany completed a public offering of 4.5 million common shares at $23. The company operates a flagship store on Fifth Avenue in Manhattan, seven other stores across the United States, a store in London and boutiques in the Mitsukoshi department stores in Japan.

Did you ever think for even a second that Tiffany shoppers were price sensitive? The tiffany jewelry store said that it earned more money during recent months and upped its forecast for its full fiscal year ending Jan. 31. Tiffany's net sales climbed 10% to $547.8 million during the quarter compared to last year. During the November-December holiday period, tiffany & Company's U.S. sales growth at stores open more than a year is exceeding its high-single-digit expectation. International sales are exceeding the company's mid-single digit expectation.
"It's a good start to the season, but the vast majority of holiday business is still ahead of us," the tiffany said.

Describe the Tiffany & Co. design philosophy.
Clarity, simplicity, vitality and sensuality are essentials. We avoid traditional and already sophisticated design vocabularies, and instead build on basics such as the observation of nature on ideas that are universal (or, as I say, "fall like rain on everyone") and are recognisable to everyone, whatever their culture. Thus, Tiffany & Co. designs worldwide appeal.
What do your designs aim to do for Tiffany & Co.?
We want to bring excitement, glamour and joy to our customers, as each person builds a jewelry and accessory wardrobe to reflect personal style.
What role does Tiffany & Co play in people’s lives?
The brand is important to customers. We are so happy and honored to be part of our clients’ ceremonies, milestones and celebrations and special moments. And many Tiffany & Co. designs are perennial favorites for anniversaries, graduations, birthdays and, of course, to accessorise fashion.
What do you think your legacy will be at the company?
I don’t like the idea of highlighting one thing. That seems so limiting. But there have been many satisfactions over the years such as building Tiffany’s silver jewellery department, which was a little $800,000 a year business when I arrived and is now one of our largest and most important divisions. The "Atlas" designsare a great satisfaction, seeing them become so successful worldwide.
Tell us about the brand??s celebrity following.
We are grateful to all of our devoted Tiffany & Co. fans. Celebrities, like all Tiffany & Co. customers, appreciate the superior craftsmanship, quality of materials and innovative design as well as the committed customer service of the highest level that we provide them. The sheer glamour of Tiffany & Co. as well plays its role.
What do you think is the appeal of the brand?
Eight generations of Tiffany & Co. customers have agreed with Audrey Hepburn’s iconic character Holly Golightly in the film "Breakfast at Tiffany’s" when she pronounced Tiffany & Co. "WONDERFUL!"
